Bail Bonds: 17 charged for fraudulently using same property in multiple bail bonds | Bareilly News

    July 21, 2024

Keshav AgarwalPilibhit: Seventeen people from various villages under Neuria police station in Pilibhit district have been charged with fraudulently using a single property as collateral for multiple bail bonds. Legal experts state that once a property is used as collateral for a bail bond, it cannot be used for another bail unless it is released by the court concerned.SP Avinash Pandey said, “The fraud was found during a review of records and documents of sureties filed for the bail of an accused in a robbery case committed on Jan 30 at a businessman’s house in Puranpur. An FIR was lodged under crime number 36 of 2024.”“The 17 people allegedly concealed information from the court about the property’s attachment to multiple bail bonds, filing fraudulent declarations that the collateral was free of any previous charges. The fraud was committed for monetary gain, as the accused charged significant fees for being sureties to obtain judicial bail orders. They acted as sureties in cases involving serious crimes such as rape, molestation, robbery, attempted murder, and cow slaughter for financial benefits and were found to be part of an organised gang,” the SP added.Police arrested two of 17 accused, Angan Lal of Maidna village and Babu Ram of Janakpuri village. They were produced before the remand magistrate and sent to jail under judicial custody.Senior criminal lawyer Ashwini Agnihotri said, “Under Section 486 of Bhartiya Nagarik Suraksha Sanhita (formerly Section 441A of the old CrPC), a surety must declare under oath that the property offered as collateral for a bail bond is not attached to any other bail bond.”SHO Neuria police station Pradeep Kumar Vishnoi confirmed, “The 17 accused have been charged under BNS sections 319(2), 318(4), 338, 336(3), 340(2), and 61(2).”
